1. Eligibility Requirements: The Mojo Balanced Energy Sweepstakes (the “Sweepstakes”) is open to those who (i) enter according to these official Sweepstakes rules (“Official Rules”), (ii) are legal residents of the 50 United States and the District of Columbia, and (iii) are 18 years of age or older, or have reached the age of majority in their state of jurisdiction at the time of entry. Employees of E-Alternative Solutions, LLC (“Sponsor”), and/or their respective parents, affiliates, subsidiaries, advertising and promotion agencies, consultants, contractors, retailers, distributors and suppliers, and the immediate families (spouse, parents, children and siblings and their respective spouses, regardless of where they reside) and individuals living in the same households of such employees, whether or not related, are ineligible to enter or win. Void where prohibited by law. Subject to all applicable federal, state and local laws and regulations.
2. Agreement to Official Rules: By participating, you agree to be fully and unconditionally bound by these Official Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Sponsor as final and binding as they relate to the Sweepstakes and the interpretation and application of these Official Rules.
3. Sweepstakes Period: The Mojo Balanced Energy Sweepstakes begins 12:01 AM Eastern Time (“ET”) June 10, 2023 and ends 12:59 PM ET September 30, 2023 ("Sweepstakes Period").
4. How To Enter: During the Sweepstakes Period, you may enter once per Entry Period (as defined below) by visiting [https://grabmojo.com/mojo-balanced-energy-sweepstakes] via web browser or by scanning a QR code found on sample product packages distributed by MOJO Brand Ambassadors at select events and public locations during the Sweepstakes Period; then completing and submitting the official entry form by providing your first and last name, street address, city, state, zip code, e-mail address, phone number (including area code) to receive one (1) entry. Submission of erroneous or incomplete personal information will void the submitted entry. Entrant may be presented with the option to complete a survey regarding Sponsor’s products or to opt-in to Sponsor’s e-mail subscriber list, neither of which is required for entry, nor will increase entrants chance of winning. Limit one (1) entry per person, per household and per e-mail address per day per Entry Period for a total maximum of sixteen (16) entries attainable for the random drawing. If entries are received in excess of the stated limitation from any person or household or e-mail address on any day, only the first entry received from such person, household or e-mail address will be eligible for entry on that day. All entries become the property of the Sponsor and will not be acknowledged or returned. Should multiple users of the same e-mail account enter the Sweepstakes and a dispute thereafter arises regarding the identity of the entrant, the authorized account subscriber of said e-mail account at the time of entry will be considered the entrant and required to comply with these Official Rules. “Authorized account subscriber” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization, which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. By submitting an entry, the entrant consents to the likelihood of being contacted by text message if selected as a potential winner. You must be a wireless service subscriber to enter via QR Code. Participation in this Sweepstakes via QR Code method may not be available through all wireless carriers and on all devices. QR Code scanning feature may require download of an application to enable. Please note that your cellular service provider may charge you standard text messaging charges for each text message you send and receive on your cellular phone in connection with this Sweepstakes. Please consult your cellular service provider regarding their pricing plans. Check your phone capabilities for specific instructions. Sponsor does not accept responsibility for any fees incurred by your wireless carrier for participation.
Alternative Method of Entry: As an alternative to entering via the above methods you may also enter by mail. Limit one (1) mail-in entry per person per Entry Period. In the entry, you must print legibly your complete name, physical mailing address, telephone number, date of birth, the name of the Event Period in which you would like to submit an entry all on an 8 ½” x 11” piece of paper. Each entry must be sent in a #10 envelope labeled “Mojo Balanced Energy Sweepstakes”. Printed address labels are considered mechanical entries and are therefore not accepted. Mass-produced entries are not accepted. Entries are to be mailed to: E-Alternative Solutions, LLC, ATTN: VP Marketing, 459 East 16th Street, Jacksonville, Florida 32206, U.S.A. Mail-in entries must be postmarked on or prior to the end date of the applicable Entry Period to be considered. Mail-in entry requests received by Sponsor outside of the timing specified above or outside of the Sweepstakes Period will not be eligible.
5. Random Drawings/Entry Periods: A random drawing will be conducted in accordance with the below schedule. Odds of winning will depend on the total number of eligible entries received.

6. Prizes (16 total): One (1) Five Hundred Dollar Gift Card (Estimated Retail Value (“ERV”) $500.00 each) per Entry Period. Total ERV of all prizes combined is $8,000. Winners will be responsible for all taxes (including federal, state and local taxes) and any other costs and expenses associated with acceptance and use of any prize not described herein as being awarded. All prize details are at Sponsor’s sole discretion.
7. Winner Notification: Potential winners will be notified by phone, e-mail or text message (Data rates may apply. See your wireless carrier for text message rates and capabilities). In the event that any e-mail or text message to a potential winner is returned as undeliverable or a response to any given e-mail, text message, or phone call/voice message is not received within three (3) days of date of its issuance or a potential winner is not in compliance with these Official Rules, the prize may be forfeited and, at Sponsor’s discretion, an alternate winner may be selected for the prize at issue. Potential winners may be required, in the sole discretion of the judges, to execute and return an affidavit of eligibility and a liability release and, where legal, a publicity release within five (5) days of date of issuance of those documents or prize may be forfeited and, at Sponsor’s discretion, awarded to an alternate winner for the prize at issue. Prizes are not transferable, redeemable for cash, or substitutable except by Sponsor, which reserves the right, at its discretion, to substitute a prize or portion of a prize with one of comparable or greater value. In the event a potential winner is not in compliance with these Official Rules, or a prize or prize notification is returned as undeliverable, the prize may be forfeited and, at Sponsor’s discretion, an alternate winner may be selected for the prize at issue.
8. Prize Conditions: If for any reason the prize is unavailable or any prize or related event is delayed, cancelled or postponed, or for any other reason, Sponsor reserves the right to modify the Sweepstakes in its sole discretion and award a substitute prize, or portion of a prize, of comparable or greater value as set forth in these Official Rules. No substitution, transfer, assignment or cash equivalent of the prize, or any portion thereof, is permitted by a winner. Sweepstakes Entities shall have no responsibility or obligation to the Winner who is unable or unavailable to, or who does not for any reason, accept or utilize the prize. All costs and expenses not specifically listed above as part of the prize are solely Winner’s responsibility. PRIZES ARE PROVIDED “AS IS”. PARTICIPANTS ACKNOWLEDGE THAT PROMOTION ENTITIES HAVE NEITHER MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE PRIZES AND ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
9. Release, Indemnification and Limitation of Liability: By submitting an entry to the Sweepstakes, you agree to fully, completely, and forever release, indemnify, and hold harmless Sponsor, and any and all of its parents, subsidiaries, affiliates, and all other related entities, general and limited partners, joint venturers, successors, assigns, beneficiaries, attorneys, insurers, subrogees, advertising and promotional agencies, representatives, agents, principals, employees, officers, directors, and anyone else acting by, for, or through Sponsor, (the “Released Parties”) from and against any and all claims, demands, actions, cause of action, damages, suits at law, suits in equity, liabilities, illnesses, injuries, death, and any other losses, suffered, incurred, claimed, or brought by you (including any of your beneficiaries, successors, assigns, and anyone acting on your behalf), whether known or unknown, that currently exist or that may arise or occur, directly or indirectly, whether caused by negligence or not, in connection with your attempted entry, or participation in the Sweepstakes. This includes, but is not limited to, (i) your acceptance, possession, use, or misuse of any Prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, or software; (iii) the unavailability or inaccessibility of any transmissions, or of telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; and (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries. ). Released Parties are not responsible for lost, delayed, interrupted or unavailable network, cable, satellite, Internet Service Provider (ISP), server or other connections, miscommunications, failed phone, computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other errors, problems or difficulties of any kind whether computer, network, human, mechanical, electronic, printing, typographical or otherwise relating to or in connection with this Sweepstakes, including, without limitation, errors, problems or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials or for any damage to entrant’s or other person’s hardware or software as a result of participation. Released Parties are also not responsible for entries or e-mail that are lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled or delayed by computer transmissions and all such entries are void. Persons found tampering with or abusing any aspect of this Sweepstakes as solely determined by the Sponsor and/or the judging organization will be disqualified, and their entries will be void. Every submission must be manually keystroked and manually entered by the individual participant and repetitive automated electronic submission of entries is specifically disallowed. Use of script, macro or automated entry software or programs or any other means that subvert the entry process is prohibited and all such entries will be void. In the event the Sweepstakes is compromised by virus, bugs, worms, non-authorized human intervention or other causes which corrupt or impair the administration, security, fairness or proper play of the Sweepstakes, including but not limited to Acts of God, epidemic or pandemic, Sponsor reserves the right in its sole discretion to modify, suspend or terminate the Sweepstakes or any portion thereof and/or terminate the participation of any participant (and void all associated entries) whose conduct potentially compromises the Sweepstakes and, if terminated, at its sole discretion to award the prizes in a random drawing from among all eligible non-suspect entries received prior to the act requiring such termination. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. CAUTION: Any attempt by an entrant to damage the website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek any and all remedies available to the fullest extent permitted by law. Any Claim or other dispute between the parties will be governed by these Official Rules and the laws of the state of Florida and applicable United States law, without giving effect to any conflict of laws principles that may provide for the application of the law of another jurisdiction.
10. Rights Granted By You: By entering into this promotion you understand and permit the use of your name and/or likenesses and/or biographical data by Sponsor and its designees if selected as a winner for advertising, promotional and other purposes in any or all media now or hereafter known throughout the world in perpetuity without compensation, permission or notification (except where prohibited by law).
11. Dispute Resolution:
a. Any dispute or claim between you, on the one hand, and Sponsor, its parents, subsidiaries, affiliates, agents, employees, and assigns, on the other hand (“Claims”) will be resolved exclusively by binding arbitration, rather than in court. There is no judge or jury in arbitration, and court review of an arbitration award is limited. Further, you will not have the right to participate as a representative or a member of a class of claimants. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages).
b. Claims include, without limitation, (a) Claims related to or arising out of any aspect of any relationship between you and Sponsor; and (b) Claims relating to the construction, scope, applicability, or enforceability of this arbitration agreement. Claim has the broadest possible meaning and includes disputes based on contract, tort, consumer rights, fraud or other intentional torts, statutes, regulations, common law, or equity. Notwithstanding the foregoing, “Claim” does not include an action to enjoin infringement or other misuse of intellectual property rights, which you or Sponsor may file in court.
c. You and Sponsor each agree to notify the other in writing of any Claim and will attempt in good faith to resolve the dispute before beginning an arbitration proceeding. Notice to Sponsor shall be sent to E-Alternative Solutions, LLC, ATTN: VP Marketing, 459 East 16th Street, Jacksonville, Florida 32206, U.S.A. If you and Sponsor cannot resolve the dispute between yourselves within 30 days of you or Sponsor providing written notice, either party may initiate an arbitration.
d. You and Sponsor agree that the arbitration will be administered by JAMS. The JAMS arbitration rules can be obtained at www.jamsadr.com or 1-800-352-5267. The arbitration will be decided by a single arbitrator selected in accordance with JAMS rules. The arbitrator will take reasonable steps to protect proprietary and confidential information. At your or Sponsor’s request, the arbitrator will issue a reasoned written decision explaining the basis for the award.
e. You and Sponsor agree that no class action, private attorney general, or other representative claims may be pursued in arbitration. Unless you and Sponsor agree, Claims of two or more people cannot be joined or consolidated in the same arbitration.
f. You and Sponsor agree that this Sweepstakes involves interstate commerce and that these Official Rules and any arbitration proceedings are governed by the Federal Arbitration Act. Any Claim or other dispute between the parties will be governed by these Official Rules and the laws of the state of Florida and applicable United States law, without giving effect to any conflict of laws principles that may provide for the application of the law of another jurisdiction.
12. Privacy Policy: Information provided in connection with the Sweepstakes will be treated in accordance with these Official Rules and Sponsor's Privacy Policy (as may be amended from time to time), currently located at https://grabmojo.com/privacy-policy/
13. Winners List: The names of the winners (available after October 31, 2023) and/or a copy of these Official Rules may be obtained by mailing a self-addressed, stamped #10 envelope to: “MOJO Winner’s List,” PO Box 11507, Bozeman, MT 59719-1507 - Winners/Rules (please specify which), for receipt no later than November 30, 2023. VT residents omit return postage on rules requests.

15. Severability: If any provision of these Official Rules shall be held void, voidable, invalid or inoperative, no other provisions of these Official Rules shall be affected as a result thereof, and, accordingly, the remaining provisions of these Official Rules shall remain in full force and effect as though such void, voidable, invalid or inoperative provisions had not been contained herein.
